Is Ireland's recycling infrastructure sufficient to its needs?Self Compliance
The alternative to Joining Repak is Self Compliance which can be costly, inconvenient and time consuming.
"Major Producer's" who self complies must:
- Register each premise with the relevant Local Authority.
- Pay an annual fee of €15 per tonne of packaging handled, the minimum annual fee per premise is €500 and the maximum annual fee per premise is €15,000.
- Accept and recycle packaging waste from the public and suppliers, regardless of where it was purchased.
- Provide detailed quarterly statistics to the Local Authority on each type of packaging supplied from each of your premises, which are then placed in the public domain.
- Provide detailed quarterly statistics on packaging waste you collect and handle.
- Provide detailed quarterly statistics on the waste you recycle.
- Provide detailed quarterly statistics on waste to be disposed by you to your local authority. Ensuring you keep this waste on site ready for inspection until such time as the Local Authority approves its disposal.
- If a Brandholder/Importer you must achieve a minimum of 50% recovery/recycling of packaging waste you import or pack/fill (per quarter).
- Display official public notices (not less than 40cm X 30cm – A3 size) at every entrance to your premises announcing that you will accept back packaging waste and indicating the facilities available at the premises for the take-back of this packaging.
- Place public notices in newspapers in March and September of each year advertising the fact the company is a self complier and take back packaging waste. Local Authorities must also advertise in newspapers on a yearly basis, details of self compliers in their jurisdiction.
WHAT IF I DO NOTHING?
Failure to comply with the regulations could result in prosecution, and fines of up to €12.7 million and or imprisonment. Local Authorities are the enforcers of these regulations and non compliant companies are being prosecuted.
